Terms and conditions
The short version. You can start free. Paid plans run month to month or year to year, and you can cancel any time. You own what you make and you’re responsible for everything on your shows, including what your staff add and having the rights to pictures, videos and music you use. Check what BigUpAI writes before you publish it. Shows you publish can be seen by anyone with the link.
1. Who we are
BigUpScreen is a trading name of Mick Brennan, a sole trader based in Dublin, Ireland (“we”, “us”). You can reach us at info@bigupscreen.com.
2. The service
BigUpScreen lets you build shows, such as launch countdowns and trivia rounds, in your browser and show them on TVs, projectors and live streams through a web link. Some features use BigUpAI, an assistant that researches topics on the web and writes content, such as the quiz packs and show content we make for you on request. We may improve, change or add features over time. If we remove something that is a main part of a paid plan, we’ll tell you first and you can cancel.
3. Your account
- You must be at least 16 to open an account. The service is designed for businesses, venues and creators.
- Give us accurate details and keep your email address up to date: it’s how you sign in.
- You’re responsible for activity on your account. Don’t share your password. If you think someone else has access, tell us straight away.
- We review new accounts before switching them on and may decline one without giving a reason.
4. Plans, prices and payment
- New accounts start with a free trial of 7 days from approval, with the limits shown on our pricing. When it ends, your shows pause until you choose a paid plan. We keep your work, and you can still sign in, download your data or delete your account.
- Paid plans have the prices and allowances shown on our pricing page when you upgrade. Showing your own name or logo on screen is included with paid plans only.
- Prices are in euro and exclude VAT. Where VAT applies, we add it at the correct rate.
- Paid plans are billed in advance, monthly or yearly. Until card payment is available on the site, we invoice you and your plan starts when the invoice is paid.
- Plans renew automatically for the same period unless you cancel before the renewal date.
- If we change a price, we’ll tell you at least 30 days before it applies to you. It takes effect at your next renewal, and you can cancel before then.
- If a payment is overdue, we may pause your shows until it’s paid.
- Welcome codes. We may email a new account a welcome code. It takes the percentage shown off your plan and extra TVs for the months shown, starting when you first pay. It doesn’t cover set-up, quiz packs or event passes, there is one per business, it must be used within the days shown in the email, and it can’t be swapped for cash.
5. Packs and requests
- Each plan includes a number of packs a month. A pack is one request: a quiz pack, or content for a show (news and facts, film facts and trivia, or a countdown). Packs reset on the 1st and don’t roll over.
- When your packs for the month are used up, you can wait until the 1st or ask us for extra packs, charged at the price shown in your account. Extra packs don’t expire. On the Free plan, choose a plan to ask for more. A request you cancel before we start on it doesn’t count.
- A request can take up to 24 hours, though most are ready much sooner. We email you when it’s ready.
- If we can’t make what you asked for (for example, there isn’t enough reliable information on the topic), we’ll tell you and the pack is given back to you. It doesn’t count towards your allowance.
- Reading your own menu or showtimes with BigUpAI is included and doesn’t use a pack.
6. Cancelling
You can cancel a paid plan at any time by emailing us or from your account page. Your plan keeps working until the end of the period you’ve paid for, then your shows pause. We don’t refund part-used periods, except where the law says we must. You can delete your account at any time from the account page. That permanently deletes your shows, content and uploads.
7. Your content
- You own the content you create and upload. You give us permission to store it, process it and show it on your shows, only so we can run the service for you.
- You’re responsible for your content. You must have the right to use every picture, video link, piece of music and trademark you put on a show. Playing music in a public venue may need a separate licence, for example from IMRO and PPI in Ireland.
- Agency accounts manage venues for their clients. The agency is responsible for the venues it adds, for what it and its clients put on their shows, including campaign pictures, and for having its clients’ permission to do so. Package limits on venues, shows and campaigns apply, and larger roll-outs need a separate written agreement with us.
- The account holder is responsible for everything shown on their shows: what they add, what anyone they give access to adds (including staff logins for the staff app, and urgent messages sent from it), pictures and videos linked from other websites, and players’ names they or their staff approve. We don’t check content before it goes on a show, so please check it yourself before you publish.
- If you use a BigUp Live show or put a show on a live stream, you must have the right to broadcast every video, picture and piece of music in it online, and you must follow the rules of the platforms you stream to (for example Twitch, YouTube and TikTok). Keep your private stream links to yourself.
- Predictions on a BigUp Live show use free points only. Points have no money value: they can’t be bought, sold, swapped or exchanged for anything, and you must not offer prizes for them that would make them gambling where you or your viewers are. Subathon timers, goals and alerts show what Twitch tells us; we aren’t responsible for missed or late events.
- Reviews you add yourself must be real reviews from real customers, shown as they wrote them. Google reviews are shown as Google gives them, with credit to Google, and you must follow Google’s rules for them.
- On a gym leaderboard, only show members who have agreed to their name being on the TV. Asking them is up to you.
- Song requests and shout-outs come from your guests. Our safety filter checks shout-outs, but it can’t catch everything, so keep an eye on what shows and take off anything you don’t want. Coach and DJ links let anyone who has them change what your TVs show: only share them with your team, and make a new link if one gets out.
- Fonts you upload must be licensed for use on public shows and online. The fonts in our own list are free to use.
- Anything you publish to a show can be seen by anyone who has that show’s link.
- Don’t publish anything that is unlawful, infringes someone else’s rights, is hateful, harassing, sexually explicit or violent, or that impersonates someone or misleads people.
- We may remove content or pause shows that break these terms, or that we’re told infringe someone’s rights. Where we reasonably can, we’ll tell you why.
8. Content written by BigUpAI
BigUpAI checks facts against sources on the web, and we check quiz packs and requested content before they reach you, but they can still have mistakes, leave things out or word something badly. The same applies to rounds taken from the BigUpScreen question bank, which are mostly written by BigUpAI. Before a venue sends its first request, or a round from the question bank is added to a quiz, the account holder or the person creating the quiz must accept a notice on screen. By accepting it, they confirm that:
- they will read and check every question, answer and story before it is shown on a show or used in a game;
- the creator of the quiz, and the account holder it belongs to, are fully responsible for everything in it once it is published, including anything inaccurate, defamatory, offensive, or that infringes someone else’s rights;
- BigUpScreen is not responsible for what BigUpAI writes, for question bank content, or for what they choose to publish.
Ticker stories. If you tick story genres for a ticker, BigUpAI writes each story automatically, in its own words, from what official bodies publish about themselves, and checks for new ones every hour. We don’t check each story before it shows. You are responsible for what your show shows, and you can untick the genres at any time.
We keep a record of each acceptance (the account, the login, the time, the questions and the version of the notice). Content written by BigUpAI is your content under section 7 once you publish it, and you agree to cover any claim, loss or cost we face because of content you publish, to the extent the law allows.
9. Fair use
Don’t try to get around plan limits, access other people’s accounts or shows, overload or attack the service, scrape it, or resell it without our written agreement. Don’t use it to send spam or collect other people’s personal data.
Our software. BigUpScreen, its name, logo and look, the software behind it, its designs and templates, and our question bank belong to us. Your plan lets you use them while your account is open; it doesn’t give you a copy or any other rights in them. Don’t copy, decompile or reverse-engineer the service, take its code, designs or questions, or use it (or anything taken from it) to build or train a product that competes with ours. Don’t remove our name or notices from it. This doesn’t stop you doing anything the law allows anyway. What you make with BigUpScreen stays yours (see section 7).
Play-along. Players must pick a friendly name; we may remove names that aren’t. Scores are for fun. If you run prizes from a play-along game, you set the rules and you’re responsible for them. Questions and answers are only shown one at a time, but we can’t promise nobody looks an answer up.
10. Other brands
Countdowns and trivia often mention games, films, music and other products. BigUpScreen is independent and isn’t affiliated with, sponsored by or endorsed by their owners. Their names and trademarks belong to them.
11. Availability
We work hard to keep shows running around the clock, but we can’t promise the service will never be interrupted. Sometimes we’ll need to do maintenance, and things outside our control, like internet or hosting outages, can affect it. For anything business-critical, have a fallback ready.
12. Pausing or closing accounts
We may pause or close an account that breaks these terms, isn’t paid for, or puts the service or other users at risk. Where we reasonably can, we’ll warn you first and give you a chance to fix things. If we close the whole service, we’ll give you at least 30 days’ notice, time to download your data, and a refund for any time you’ve paid for but can’t use.
13. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
- If you use BigUpScreen for business, we aren’t liable for lost profits, lost revenue, lost data or indirect losses. Our total liability to you in any 12 months is limited to what you paid us in that time, or €100 if that’s higher.
- If you’re a consumer, you have legal rights under Irish and EU consumer law, and these terms don’t affect them.
14. Your data
Our privacy notice explains what personal data we hold and why, and how to download or delete it. When you put other people’s details on your shows, our data processing agreement covers how we handle them for you.
Your quiz players’ data
When people play your quizzes on their phones, BigUpScreen collects a small amount of data about them: the nickname they choose, where they say they’re from, their phone type, their scores, how they joined and, if they tick a box asking for it, their email address for your news and offers.
- Who is responsible. BigUpScreen is the controller of players’ sign-in details and game records, and of the email lists players join. We decide how that data is kept and protected, and we answer players’ data requests. You receive reports and can send emails through the studio.
- What you get. Reports show nicknames, never emails. Emails to your list are sent by us. You can’t export the addresses, and you must not try to collect them another way through BigUpScreen.
- Emails you send. Only send what players asked for: quiz nights, prizes, events and offers from you or your sponsors. Keep it honest, don’t send more than our limits allow, and don’t use the list for anything unlawful or unrelated. We may pause emailing for an account that gets complaints.
- Sponsors and advertisers. You can sell adverts on your quiz shows and sponsored space in your emails. You can share the totals in your reports (for example, the sponsor report). You can’t share or sell players’ details, and our reports are built so you never hold them.
- Player requests. If a player asks you for their data or to delete it, point them to the menu on www.bigupscreen.com/play, or to info@bigupscreen.com. We handle it.
- When you close your account. Your players’ ticks for your email list are deleted with it.
15. Changes to these terms
We may update these terms. If a change matters, we’ll tell you by email or when you next sign in, at least 30 days before it applies. If you don’t agree, you can cancel before it takes effect.
16. Law and disputes
These terms are governed by Irish law, and the courts of Ireland deal with any dispute. If you’re a consumer living elsewhere in the EU, you can also rely on the consumer laws and courts of your own country. Before anything formal, email us and we’ll do our best to sort it out.
